Qace Academy Terms of Service

1. Introduction

Welcome to Qace Academy (“Qace,” “we,” “us,” or “our”). By accessing or using our website (https://qaceacademy.com), platforms, services, courses, and related content (collectively, the “Services”), you agree to these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use or access the Services.

2. Eligibility & Registration

1. Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services. If you are under 18, you may only access Services with the involvement and consent of a parent or legal guardian.

2. Account Creation: To enroll in any Qace course or access certain features, you must create an account. You agree to provide accurate, complete, and current information during registration and to update this information as needed to keep it accurate.

3. Account Security: You are responsible for maintaining the confidentiality of your account credentials (email and password). You agree to notify Qace immediately of any unauthorized use of your account. Qace is not liable for any loss or damage resulting from your failure to maintain the security of your account.

4. Corporate Users: Corporate entities must be duly organized and validly existing under the laws of their jurisdiction.

3. Services & Course Enrollment

1. Course Offerings: Qace Academy provides online and in-person educational programs, training courses, workshops, and certification preparation in technology, software testing, automation, data analytics, and related fields. Course details (syllabus, duration, fees) are published on https://qaceacademy.com.

2. Enrollment Process: To enroll in a course, select your desired course, complete the registration form, and pay any applicable fees. Your enrollment is confirmed once Qace’s platform (or an authorized payment processor) accepts your payment.

3. Access Period: Upon successful enrollment, you will have access to course materials for the duration specified in the course description. Qace reserves the right to modify course schedules or content with reasonable notice.

4. Consulting Services: We provide consulting services to help organizations improve their software testing processes and methodologies.

5. Talent Hiring: We assist organizations in hiring skilled software testing professionals from our talent pool.

4. Fees & Payment

1. Tuition & Fees: All course fees, tuition, and any additional charges (e.g., certification exam fees, materials, shipping) are listed on https://qaceacademy.com or communicated during enrollment. Fees are subject to change; however, changes will not affect any course in which you are already enrolled.

2. Payment Methods: We accept payments via credit/debit card, bank transfer, UPI (where applicable), or other methods as specified at checkout. All payments must be made in the currency indicated.

3. Late Payments: If payment is not received by the due date, Qace reserves the right to suspend your access to course materials until full payment is made. Continued non-payment may result in account termination.

4. Taxes: You are responsible for all applicable taxes (sales tax, VAT, GST, etc.) on your purchase. Qace will collect and remit taxes as required by law.

5. Refund & Cancellation Policy

1. 7-Day “Cooling-Off” Period: You may request a full refund within 7 calendar days of your initial purchase, provided you have not accessed more than 10% of the course content or attended more than one live session (if applicable).

2. Partial Refund (Day 8–21): If you request a refund between Day 8 and Day 21, you may receive a 50% refund, provided you have completed no more than 30% of the course content and have not accessed any graded or certification components.

3. No Refund (After 21 Days): Refund requests made more than 21 days after purchase will not be honored. If you have completed over 30% of the content or received a certificate, no refund is available.

4. Course Cancellations by Qace: If Qace must cancel a course for any reason, you will receive a 100% refund of the tuition paid or a credit note valid for 12 months, at your choice.

5. Refund Process: To request a refund, email refunds@qaceacademy.com with your full name, order number, course name, purchase date, and reason. Refunds are processed within 10 business days of approval.

6. Intellectual Property

1. Ownership: All content, materials, logos, trademarks, course videos, written materials, software, and graphics provided as part of the Services (“Qace Content”) are the exclusive property of Qace Academy or its licensors.

2. Limited License: Upon payment, you receive a non-exclusive, non-transferable, revocable license to access and use Qace Content solely for your personal, non-commercial educational purposes.

3. Restrictions: You may not copy, modify, reproduce, distribute, publicly display, or create derivative works from Qace Content except as expressly permitted in writing by Qace. Uploading course materials to third-party websites, sharing login credentials, or allowing unauthorized persons to access content is prohibited.

4. User-Generated Content: Any ideas, feedback, suggestions, or materials you submit to Qace (“User Content”) will be considered non-confidential and non-proprietary. By submitting User Content, you grant Qace a perpetual, royalty-free, worldwide, transferable license to use, modify, publish, and distribute that content.

7. Acceptable Use & Code of Conduct

1. Compliance with Laws: You agree to comply with all applicable local, national, and international laws while using our Services.

2. Prohibited Activities:

   • Uploading or distributing any unlawful, harassing, defamatory, or infringing material.

   • Cheating on assignments, plagiarism, or any form of academic dishonesty.

   • Sharing your account credentials or using another user’s account without authorization.

   • Attempting to hack or gain unauthorized access to Qace’s systems or other users’ data.

   • Disrupting or interfering with the security or integrity of Qace’s networks or systems.

3. Account Suspension/Termination: Qace reserves the right to suspend or terminate your account, block access to any Services, and withhold refunds for any violation of this policy or suspicion of abusive behavior.

8. Privacy & Data Protection

1. Privacy Policy: Qace’s collection, use, and storage of personal information is governed by our Privacy Policy. By using the Services, you consent to the privacy practices described therein.

2. Data Security: Qace implements reasonable technical and organizational measures to protect personal data against unauthorized access, alteration, disclosure, or destruction. However, Qace cannot guarantee absolute security of data transmitted over the internet.

9. Disclaimers & Warranties

1. No Warranty: The Services and Qace Content are provided “as is” and “as available,” without warranties of any kind, express or implied. Qace expressly disclaims any warranty of merchantability, fitness for a particular purpose, or non-infringement.

2. Accuracy of Content: While Qace endeavors to provide accurate and up-to-date course materials, we do not guarantee that all content is error-free. Course materials are subject to revision at any time without prior notice.

3. Third-Party Links & Resources: The Services may contain links to third-party websites or resources. Qace is not responsible for the accuracy or availability of content on those external sites and makes no warranty about them.

10. Limitation of Liability

1. Exclusion of Damages: To the maximum extent permitted by law, Qace and its affiliates, officers, agents, partners, and employees will not be liable for any indirect, incidental, special, or consequential damages (including but not limited to lost profits, data loss, or business interruption) arising out of or related to your use of the Services.

2. Cap on Liability: Qace’s total aggregate liability for any direct damages arising from or in connection with these Terms shall not exceed the amount you paid to Qace for the specific course in the 12 months preceding the event giving rise to liability.

11. Indemnification

You agree to indemnify, defend, and hold harmless Qace Academy, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or in any way connected with:

• Your breach of these Terms.

• Your violation of any rights of a third party.

• Your use or misuse of the Services.

12. Termination & Suspension

1. Termination by You: You may delete your account at any time by contacting support@qaceacademy.com or using the “Delete Account” feature (if available). No refunds will be issued for partial use of content unless covered under our Refund Policy.

2. Termination by Qace: Qace may suspend or terminate your access to the Services, with or without notice, if you violate these Terms, infringe intellectual property rights, or engage in illegal activities.

3. Effect of Termination: Upon termination, your right to access and use the Services immediately ceases. Any provisions that, by their nature, require continuing effect (e.g., intellectual property, indemnification, disclaimers, limitation of liability, governing law) shall survive termination.

13. Governing Law & Dispute Resolution

1. Governing Law: These Terms are governed by and construed in accordance with the laws of [Country/State], without regard to its conflict of law principles.

2. Dispute Resolution: Any dispute arising from or relating to these Terms shall first be addressed by good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of [Arbitration Institution], with the seat of arbitration in [City, Country]. The language of arbitration shall be English. Judgment on the arbitration award may be entered in any court having jurisdiction.

1. Account Creation: Users may need to create an account to access certain Services. Users are responsible for maintaining the confidentiality of their account credentials.

2. Account Responsibility: Users are responsible for all activities that occur under their account.

15. Modifications to These Terms

Qace reserves the right to modify or update these Terms at any time. If we make material changes, we will notify you by posting a notice on https://qaceacademy.com or sending an email to the address on file at least 30 days before the changes take effect. Your continued use of the Services after the effective date constitutes your acceptance of the revised Terms.
